Abstract

The aim of this paper is to analyse the original legal context of the terms ‘commitment’ and ‘engagement’ to determine their correct meaning. In arbitration and promise of marriage a vigorous ethical root can be found, necessary to explain them. Moral grounds come in particularly strongly into the legal sphere in these cases. The term ‘engagement’, belonging to the French legal jargon and regarding the law of obligations and contracts, is here connected. Exported to the English language, a new contractual figure is also subject of discussion: the relational contracts.
